In 1764 a twenty-six-year-old Italian named Cesare Beccaria published an anonymous pamphlet arguing that punishment should work like arithmetic. People weigh what they might gain against what it might cost them, so the job of the law is to make crime a bad bargain. He said the calculation has three parts: how likely you are to be caught, how quickly punishment follows, and how harsh it is. Then he made a claim that got him denounced across Europe: the first one matters most, and the third one matters least. Two and a half centuries of research later, this page shows you how that claim held up.

The weights in this model come from the balance of evidence rather than from any single study, so treat the meter as a teaching device rather than a prediction, and read the honesty note underneath before you draw any conclusions from it.

Try this. Push severity all the way to the top and leave certainty near the bottom. Then do the reverse. The difference between those two settings is the entire argument of this page, and it is also the difference between most crime policy of the last fifty years and what the evidence supports.

What this meter is and is not. It is a weighted illustration built to reflect one robust finding, that certainty dominates severity, plus the well-supported claim that severity has sharply diminishing returns. It is not a validated model, it does not predict crime rates, and no responsible criminologist would use it to set policy. Chapter 1 asked you to notice when a model is a mechanism demonstration rather than a measurement. This is one.

Certainty is not a slogan. It is a number.

Deterrence talk usually stays abstract. It does not have to. Police departments report how many offenses they clear, meaning solved by arrest or closed by other means, so we can look at what the certainty of getting caught actually is in the United States.

About 14 in 100 burglaries end in a clearance. Now stack that on top of what you learned in Chapter 2. Only about 40 percent of burglaries are reported to police in the first place, so the odds that any given burglary produces an arrest are far lower than the clearance rate alone suggests. Multiply the two and you are somewhere near 6 in 100. Beccaria's first dial, the one he said matters most, is turned down close to the floor for most property crime in America.

This is why the certainty finding is not an argument for doing nothing. If certainty is what deters, then the policy lever that matters is the one that raises the chance of being caught, not the one that raises the sentence for the small share who are. That is also why the research on visible policing in high-crime places shows effects while the research on longer sentences mostly does not. Both findings are the same finding wearing different clothes.

Read clearance rates carefully. A clearance is not a conviction, and cleared by exceptional means can include cases closed without an arrest. Clearance rates also depend on reporting, on how agencies count, and on which agencies submit data at all, which is the Chapter 2 problem arriving again. Use these numbers to make the point that certainty is low, not to rank police departments.

Testing the dial Beccaria said to leave alone

Severity is the lever American policy has pulled hardest for fifty years: longer sentences, mandatory minimums, three-strikes laws, capital punishment. Beccaria predicted in 1764 that this lever would do the least work. Before you see what the research says, commit to an answer.

What does the weight of criminological research find about increasing the severity of punishment?

The National Institute of Justice puts it about as plainly as a federal agency ever puts anything. Its summary of the research says the certainty of being caught is a vastly more powerful deterrent than the punishment, that increasing the severity of punishment does little to deter crime, and that sending someone to prison is not a very effective way to deter crime. It notes two reasons severity underperforms. First, people considering an offense usually do not know the specific penalty attached to it, so a legislature can raise a sentence without changing anyone's perceived cost. Second, prison itself can be criminogenic, meaning it can make future offending more likely rather than less, partly through what people learn and who they meet inside.

The hardest case: does the death penalty deter?

In 2012 a National Research Council committee reviewed three decades of studies and reached an unusually blunt conclusion. Research on the effect of capital punishment on homicide, it found, is not informative about whether capital punishment decreases, increases, or has no effect on homicide rates. It recommended that these studies not be used to guide policy at all. That is a stronger statement than saying the death penalty does not deter. It says the evidence cannot currently answer the question, which is a different claim and a more honest one.

Now notice how well Beccaria anticipated all of this without any data. He argued that a punishment should be only as severe as necessary to make crime a bad bargain, and that going beyond that point is not just cruel but counterproductive. He even named a mechanism, arguing that public executions could brutalize a population rather than restrain it, which is why the modern literature still uses the term brutalization effect. He reasoned his way to a conclusion in 1764 that took criminology two hundred years and a great deal of data to confirm.

Say this precisely on the exam. The finding is not that punishment does not matter. It is that the certainty of apprehension does far more deterrent work than the severity of the sentence, and that severity has sharply diminishing returns. A student who writes that criminologists think punishment does not work has written something the research does not say.

A philosopher with no data got the biggest question right. Beccaria had no crime statistics, no control groups, and no way to test anything. He reasoned from an assumption about human beings, that we weigh costs against benefits, and he followed it carefully. On the central question of which lever matters most, he beat two centuries of policy intuition. That is a real argument for the value of clear reasoning.

And now the other half of the lesson, which matters more. Being right by reasoning alone is not the same as knowing. Beccaria had no way to tell whether he was right, and neither did anyone else for two hundred years. Lombroso, whom you meet in the same chapter, reasoned just as confidently from an assumption about human beings and was catastrophically wrong, and it took Goring's control group to prove it. The difference between the two men is not that one was smarter. It is that eventually someone checked. Chapter 1 called this falsifiability, and this chapter is the story of the field learning to insist on it.

  1. Visit the Lombroso Museum of Criminal Anthropology site or the Atlas Obscura write-up, both linked in the module. Pick one artifact or one specific claim.
  2. Explain what Lombroso believed it proved. Be fair to him and describe the theory as he understood it, using the chapter's vocabulary: atavism, stigmata, criminal anthropology, the born criminal.
  3. Dissect it with the tools from Chapters 1 and 2. Was the claim falsifiable? What was his comparison group, and what should it have been? What did his measurements actually measure? Goring's 1913 study is the model here, so use it.
  4. Close with the transfer question. Name one claim you have encountered outside this class that shows the same failure pattern: strong determinism, weak measurement, and a conclusion that happens to match an existing prejudice.

How this is graded: the points are in the dissection, not the outrage. Everyone agrees Lombroso was wrong. What earns credit is showing exactly how the reasoning failed, in the specific technical language this course has given you. A post that says his ideas were racist and harmful is true and earns little. A post that explains that he measured only convicts and therefore could not distinguish criminal traits from ordinary human variation earns full marks.
